Not so. If his other job is not in this industry then the WTD does not come into play, the 39 hours would not count toward the 48 hour average and 60 hour maximum per week working time for the WTD as it applies to a mobile worker. Those hours will only apply for the EU Driver’s Hours Regulations.

I start mon 0800 and finish fri 1530, with occasional overtime.

My job title is DRIVER/LABORER (though the laborer bit rarely applies, I do a lot of fabrication and steelwork)

Now that I’ve got the “C”, part of my job will be to drive work’s 7.5tonner. until I leave,that is :laughing:

That makes a difference. I assume that will require use of a tachograph in which case the WTD for mobile workers will indeed apply to you and you will have to make sure you don’t exceed 60 hours work for the week, only driving and work count, not breaks or POA, toward the 60 hour total. As you will only be able to do one driving shift every two weeks your average of 48 hours shouldn’t be a problem thanks to all those 39 hour weeks.

If you are driving the 7.5 tonner every working day you will obviously need tacho records for each of those days but if you only drive it on certain days you will still need a record for each day you work. The only weeks you would need to keep no daily records for are weeks when you do no driving at all.

I’m no expert on this - coffeeholic, tachograph & geebee45 are - but I’ll try to answer some.

the 48 hours is a combination of driving & other work not breaks or POA (told you are going to be waitng but being ready to start again) and is an average over 17 or 26 weeks (depends what you agreed with your employer)

van driving is other work

you can usually only do one day every other weekend due to the weekly breaks that need to be taken under EU rules.
A tacho must be filled in for each day worked (name ,start & finish time) using a seperate one for each day for the week in which you came under EU regs (sun midnight to sun midnight)
