Need advice.......Would it be a good move?

Steve-o:
Just wondering… Say in the last month, how many times has your shift length been more than 13 hours but below 15 more than 3 times in a week?

How many times in the last month have you gone over 15 hours?

its probably happening twice a week. sometimes 3, all depending on when i go to london

@tachograph, we run digi tacho…on 2 man crews

I see, are you double manning ie 2 drivers from within 1 hour of the journey start to finish ?

Some good advise given regards staying or jumping, all I will add is regarding the 15 hours, since I started working for my current employer I have hit the magic 15 hours twice and both times pulled into a lay-by and they have fetched me back, I wouldn’t risk my licence for any company or delivery !!

i thought they could only fetch you back if youve run out of driving time and have work time left,i thought if youd done your 15 hrs that was it,switch off ignition off and go to sleep,COFFEE

True when you’ve reached 15 hours the company are not legally allowed to fetch you back to base, the time travelling counts as other work so there’s no way you could have a legal daily rest period.

Still I guess if no-one finds out about it …

I was under the impression that they could fetch you back as long as they sent two drivers out so you didn’t have to drive the car/van back to base ■■ Surely that’s better than being stuck with no water, food, bedding etc …

i work at 3663 at the mo pal n all drivers that have been takin on in the last 12 months have been put on set wages on a 53 hr week n us lot get paid for what we do etc top n bottom of it is we earn more than them n now work are tryin to put the rest of us on this new contract wich is crap n worth about 5 grand a yr less if u include overtime etc my advice is if u can n if its possible get in a union n get the union man to fight your corner

as for goin over hrs it has happend to me a few times n its been down to bad planning of routes 1st time i sat on services waitin to b picked up so went n spoke to planning dept week after nothin changed n i ended up gettin picked up again 3rd i brought half a waggon full of stock back they never messed me around again just play the system take ur time dont rush round n if they question say il work as hard when im paid the sam hope this hepls buddy

My advice, DO NOT break the law for anyone, it is you that will pay the price, and the company will just get some other poor mug to deliver the goods.
As for the pay issue, well if you have another job lined up, and you hand in your notice, they might offer to make your pay up to that of the other drivers, but don’t do anything if you don’t have another job to go to.

Good shout jon, i never wanna break the law but when there is nothing about, i have to stay put. Like i said in OP, i wanna send off covering letters and CV before making a decision, but need advice from people that have been there, IE, you ugly lot

Sod them mate, when you get close, take it all back, as close to your 15hrs as possible, then you don’t have to explain anything until tomorrow

It may be better but technically it’s not legal

Where a vehicle coming within the scope of the EU rules is neither at the driver’s home nor at the employer’s operational centre where the driver is normally based, but is at a separate location, time spent travelling to or from that location to take charge of the vehicle may not be counted as a rest or break, unless the driver is in a ferry or train and has access to a bunk or couchette.

lets just say that, at the moment im driving a 7.5tn skeletal.......no sleeping room, just 3 seats and a wheel. and apart from it being frowned on, youll never catch me trying to go to sleep in the same cab, with the guy thats sat next to me

the bottom line, like a few of you have pointed out is that i must have mug written on my forehead. Its always felt that way since i started but i`ve had to do whats neccesary for my family…now its starting to affect certain aspects of that.

I always new that driving for a living is no easy life, but i have a m8 that works for downtons…tramping and hes home more than me! At this moment, everything im doing is for more experience but at the same time, trying to stay legal.
lol, the amount of times that ive been to dover and back, this month and caught mr VOSA, hiding behind a bush on the M20 and not been pulled. Someones looking over me

With all taken on board, start the search and do what i need to do. Thanx for all the input fellas, Keep living the dream :unamused:

i have a family so i cant make any rash decisions that will affect them.

Rock and a hard place springs to mind. :open_mouth:

And your quite happy to break the law for them and leave yourself wide open to making your family suffer when you have large fines thrown at you from the courts which YOU will have to pay ■■?

I dont see a rock or a hard place I just see you heading for a big fall, its just a matter of how high you get before you fall before you know how much the pain is going to be financially.

Stonehouse69:
.on 2 man crews

Sorry I missed this one

Is that 2 drivers or just 1 driver and 1 labourer?

If it’s 2 drivers doubled manned then you aint breaking the law exceeding 15 hrs

As DD says above.

But if only 1 driver, then surely the co. are out of order by setting a delivery schedule beyond what can reasonably be expected to be achieved?

Don’t move until you’ve got something else.

But, in the mean time, take your foot off the loud pedal, take your full legal breaks, learn the difference re the law of 1 driver and 2 drivers. Be selective about when you complete the run and when you take goods back - and do take them back! Never mind the boss man says you can’t, the law says otherwise.

All employees are willing to help out now and again for a decent employer, but when you work for a poor employer play him at his own game, or else VOSA and the law will be deciding your fate.
