Do they have a base north of the border ? Think one of our new guys said he ran hanging meat for them out of somewhere in Ayrshire. I could be wrong though.

Kick up the arse you say?

From Commercial Motor 10/11/05

A Welsh-speaking operator, who claimed to be “confused” by the O-licensing regulations, has lost his appeal against the Welsh Traffic Commissioner David Dixon’s refusal to grant him a licence.Holyhead-based John Rhys Williams’ application for four vehicles and two trailers in the name of JRW Services was rejected because of unauthorised vehicle use and convictions for the falsification of tachograph records. Williams was granted a licence in 1996; this was surrendered when a limited company he formed, JRW Services, was granted a licence in 2000. That company was dissolved in May 2003, but its licence was not surrendered and Williams continued to operate vehicles under that licence without notifying the TC of the change. Williams was employed as a driver by NR Evans from July 2002 to February 2003; following an investigation into that company’s activities he was convicted of eight offences of falsifying tachograph records, asking for 14 similar offences to be taken into account. The TC concluded that Williams had lost his repute because of those convictions and the unauthorised use. He remarked that Williams was not a novice in the industry and knew different licences were required when operating as a sole trader and as a company. He must have done because he had applied for a new licence in 2000 when changing his trading status from a sole trader to a limited company. Dixon concluded that the tachograph convictions were serious as they directly affected road safety.Tim Nesbitt, appearing before the Tribunal for Williams, said he was unsophisticated and his first language was Welsh. He had been genuinely confused about the O-licensing regulations when he had reverted to being a sole trader and if he had made a fresh licence application in 2002 it would have been granted.

There had been a widespread culture of the falsification of tachograph records in NR Evans’ workforce, with 60 drivers being convicted of a large number of offences, Nesbitt added. One of Williams’ complaints was that the NR Evans’ licence had not been revoked although that firm had overworked its drivers and put them under pressure without adequate training or monitoring. That decision must be relevant to Williams’ case, he argued. The Tribunal rejected that argument because by the time of the NR Evans public inquiry the company had replaced personnel and overhauled its systems to the extent that the TC concluded they could not be improved. Falsification offences could not be categorised as anything other than serious, said the Tribunal. As an experienced operator and transport manager Williams should have known the hours and tachograph rules and the implications of falsifying tachograph charts.

Yep and they were suspended for about 2 months (so i was told not a fact btw)

So yes that would constitute in my eyes as a kick up the arse (as i’d already said) because now they know under no uncertain circumstances can they continue trading that way and that the T.C. and V.O.S.A. will probably keep a very close eye on them for some time to come.

I really fail to see the point of your post DOM PERRY as well err your not really making one, so if you have a problem with the way N.R.Evans are run now then please do share the reasons with us as i freely admit i know very little about their present day running other than what facts i see for myself as i go along. As i havent done an actual proper shift for them yet then i am in no position to possibly comment.

My point in my O.P. was that for a company that has had such an alledgedly shady past that they really seem to be making a 101% effort to do things the right way now.

I mean how many companies have any other drivers here had to do 2 full days induction/training not many i’ll hazard a guess. And besides that why would you explain to new drivers in great detail the ins and outs of the current rules and regs and make sure that they understand them and then expect them to run bent afterwards  That to me would be like a burglar ringing you in advance asking if its convenient for him to come round later that night to rob you

However they operated in the past bears no relevance to me what so ever as my only concern is what they operate like now and in the future

Its not about the mistakes we have made its about the lessons we learn from them mistakes and i’ll be honest with you if they havent learnt from them then i will be severely ■■■■■■ off and will tell them in no uncertain terms where to stick their job because luckily for me i’ll always have a job back at my old firm

and on a final note on this subject a snippet of the quote YOU posted…

In DOM PERRYS quote it was:
The Tribunal rejected that argument because by the time of the NR Evans public inquiry the company had replaced personnel and overhauled its systems to the extent that the TC concluded they could not be improved .

They run loads out of Kirkcudbright dairy, with a small depot at Dalbeattie, can’t recall the runs though. 1 of my pals worked for them, never had a problem with pay, did the 4 on 4 off but was laid off about 4 months ago due to reduced production at the dairy.
Bang on about the shiny motors though, I recall he had a few problems with the brakes etc on MOT’s and that for a 55 reg Scania.

Sigh.

You said: “I know there have been some horror stories about this firm in the past but it appears that they have had a major kick up the arse at some point.”

My post was to supply some facts to back up your quote and to illustrate a)there had been quite serious issues and b)that they appear to have resolved them.

Fair enough then :grimacing:

Fingers crossed that’s the case and it certainly sounds like it. Reed Boardall went through a similar transformation but that had more to do with how it treated its drivers than running bent.

I see they are after drivers at aldridge £112.50 per shift.Must like weekend working aswell.
