Important for those running to or via spain

it looks like my company will have to find another copy of the form as ours is in PDF format that cannot be edited, so has to be filled in with a biro, when they find one in word format I will put it on my PC and edit it myself and print it off in the cab, now where did I put that company stamp :wink:

most of the prblems with the ones in Biro were either the Gendarmes on motorbikes, those pig ignorant pratts near Pamplona and the Mossos in Catalunya, everywhere else did not seem to be too bothered

there’s no need (or place) to stamp the latest format, they’re supposed to be on company letterhead?

Under Spanish law it is unenforceable.
You cannot be forced to supply documentacion in a minority language unless it is the official language of an INDEPENDENT country.
Is it law to carry these attestations in Welsh ? or is English acceptable

do you know how many regional languages Spain has ?

imagine the chaos if it was obligatory to carry attestations in everyone of these languages to drive through Spain

that would also mean it would be obligatory when in the UK to carry them in Welsh, Cornish and English
or in Belgium in Flemish, French and German

EU law states the one of the official languages of the countries that will be transitted

You are forgetting Andalus - granted not a language, but one hell of a dialect, particularly around Granada it can be unintelligible at times.

The Authorities are being real ■■■■■■■■ there at the moment, a few weeks ago had a vehicle fined €6700! We do a lot of work that involves double manning for part of a tour, our coach had two drivers for a drive from Copenhagen to Frankfurt, driver one changed the cards and driver two got into the seat and changed the cards back! At first glace it would look like driver 1 had done 8 hours driving without a break, a manual entry was made on the back of the chart expalining what had happend, two weeks later the bus was heading through Irun towards France and the driver stopped a the Autogrill 2km short of France for fuel when they checked him! beware they will fine you for alleged offences committed in other countries. There was also an issue where the driver had not recorded a positioning move from Oviedo to Madrid when we had another driver drive the bus to cover a 45 hour break.
Our driver was left with no information on how to pay or what to do, we managed to find an English speaking Solicitor in Alacanite who got bank details to enable us to do a transfer, this still took 5 day as it was over a holiday weekend, we had to fly our guy home and I flew out to pick up the bus. The only saving grace was that the bus was empty and we didn’t need it in a hurry. I have since found out that DKV will appoint a local agent who will sort it out the same day for 5% surcharge.
I also know of one other instance of drivers being fined for the changing the disks twice, on this occasion both drivers were still on the bus, it must of been obviuose to anyone with half a brain the it was a genune cockup, but they were still fine €3500.
This happened almost 8 week ago and we still have had no paperwork from the Spanish to enable us to contest the level of fine.
We also had a bus with a digital tacho stopped, funnily enought they didn’t know what to do and let him go with no problem!!

Something very similar happened to one of the British racing teams going to Jerez a couple of years back. Drivers forgot to swap cards on change over, (can easily be done, if they are distracted when they stop and they both think the other one did it.) They get stopped an hour or so later and find about €3000. Their boss had to fly out to pay it, as the truck was due in Jerez and we get fined about €200,000 for not putting a both cars out on the circuit, even if it’s only for one lap.

I also heard that one of the Bridgestone trucks got stopped and impounded, because of the langauge barrier the driver couldn’t understand what the problem was. In the end they got hold of somebody who could translate and found out that the tacho card they were using had the wrong E number on it, They got a €1000 fine for that one.

Even the Spainish race teams get pulled on regular occasions and fined for what seems like very petty things that haven’t really caused anybody a harm and could have easily been dealt with by a warning.

Was the driver capable of explaining to them what had happened ■■? and If not then obviously you wil get fined and under EU law hours offences can be punished in other countries of the EU. Do not forget the laws are worded in a manner that puts the onus on you to prove your innocence if you cannot then you are automatically guilty

Then why did the 2nd driver not leave fotocopies of his discs with the vehicle ? that is what we do

wrong the police would automatically have given a telephone or fax number with the bank details in order for you to effect payment

There are specialised companies for fine payments who will pay them in a matter of hours for a small percentage of the fine and they will automatically appeal every fine and return any money won back to you with in 7 days of receiving it.

a ■■■■ up is a mistake and if it leads to incorrect entries on the discs then it is a fine you cannot complain about that one

Appeal instructions should be on the back of any ticket issued or on a seperate piece of paper, or if you are member of any reputable organisation they should be able to tell you how to proceed

do not believe that as anyone who goes to Spain regularly will tell you the Spanish have known now for a very long time exactly how the digital tachos work

Basically these fines occur because of the amount of fiddling that has occured over the years but if you do yuor homework before going to these countries and instruct your drivers accordingly these problems are easily avoided with respect to fast payment and appealing fines look in internet for companies that specialise in this sort of thing there is a Portuguese company that specialises in this who also have an office in London but there name escapes me at the moment.
