you are liable to arrest if you hand your keys to an unqualified driver
Cobblers: I doubt the clerks in RDC’s have any licence at all. In many places you just wont get tipped if you dont hand your keys in, chock your wheels, and sit in a draughty waiting room.
I does annoy me when people make stupid statement like this.
On the OP - I do multi drops in a six axle artic and, if some clever clogs wants me to go somewhere i don’t think is sensible I just explain that I am not going to. If they won’t unload me, I ask for their name so i can phone my depot. It’s amazing how often, when you ask these characters their names, they change their minds.
Santa’s golden rule for small yards:-
ALWAYS turn round before you tip if possible. If you don’t, you can be sure that there will be three trucks in the way when you are tipped.
You’ve just shattered my illusions santa…I always thought you had a sleigh pulled by reindeers

Maybe, but his sentiment is right !! Anydriver would be well within his rights to print off a few ‘disclaimer’ slips that anyone asking for his keys could sign to say they have them and accept responsability for the vehicle whilst they are in possesion of them I don’t believe many clerks would be willing to sign such a notice, that would be good fun and also a genuine and fair request. Get them to print and sign their name

Ok santa.
Lets say you park up for the night, then go down the pub and get hamered.
You go back to your truck with the keys.
You can be prosecuted for being drunk in charge of a motor vehicle.
You go to an RDC.
You hand your keys in to an unqualified driver.
Who is in charge of that vehicle? You or him?
What if the guy goes for a few beers at lunch time and drives your truck?
(a long shot, i know) but it’s the question of who is responsible.
What if he drives it sober and injures someone, who gets done? you or him?
Even if they decide that you are not completely responsible, You will no doubt be his co-accused.
I will contact the CPS for a more qualified opinion.
They have told me that for you to not be liable if anything was to happen with regard to handing your keys in to an unqualified driver, The RDC would have to notify you that they take full responsibility for any claims with a notice explaining this, Otherwise YOU are fully responsible.
so it’s not such a stupid comment that i made after all.
If they don’t have a licence then they can’t be insured and if you allow an uninsured driver to use your vehicle then you’re liable for prosecution, so I can the logic behind it.
But just handing your keys in does not mean that you are permitting the key holder to drive your vehicle.
Merely allowing him to take charge of the keys, not the vehicle.
Limeyphil, your answer from the CPS is not as straightforward as you think.
regard to handing your keys in to an unqualified driver,
.
You would not be handing your keys to an unqualfied DRIVER, you would be handing them to an office clerk (presumably) for safekeeping, who you are not expecting or permitting to drive the vehicle.
Stretching the point to an extreme.
If you hand in your keys at the office when you have finished the days work and go home, are you responsible if the traffic clerk goes for a spin?
However, the point you raise is one that does need absolute clarification.
Perhaps you could post the phone number of the CPS office you phoned so that we can all ring them and force a definative answer.

Prety much so.
But i shouldn’t have used the word ‘illegal’.
But the phrase ‘potentially commiting an offence’. would have been better.
The most likely thing to happen though, Would be if you turned up at 1800 and explained that your 15 hours is up at 2100. But you don’t get tipped until 2300. They know you won’t drive it, So the ■■■■■■■■ in the office does it and injures someone. Plus your card is then [zb]ed up.
But solid clarification from the cps, police, vosa, traffic commisioners. Is the only way we as drivers can be covered.
del949:
So, can you post the phone number that you rang?
CPS.02077968500.
I’ll do better than that soon.
i’m waiting for it in black and white from the cps and from the police hq.
so i’ll stick on a new thread. hope to have it sorted by the weekend.
Something nobody on the post has mentioned,If you go into an RDC with a hand in keys policy and you say NO,wont they just say, out the gate you’re barred,if your boss backs you up,your firm is barred and some other firm will be in doing" your" work like a shot.
Not handing keys in will only work if everybody does it ,don’t think there is much chance of that in this present financial climate,or am I missing something.
derek
I really cannot see any bosses backing you up on this.
To be honest I don’t really mind handing in the keys, its the bit about not being allowed in the cab that bothers me.
Only had one company where I go that asks for keys, and I simply take off the alarm key and keep that with me. but I am allowed to stay in cab.
