The truck driver could and should have just eased off the gas pedal a little but having said that the car driver is the one forcing himself/herself onto the carriageway when quite clearly there is a rather large moving object ie a truck already there. Ignorance is no excuse when it comes to the law, the truck driver would have seen the car in his mirrors prior to the collision but at the end of the day the lorry was all the time in the car drivers view and the car driver should have adjusted his/her speed accordingly, the fact that the truck driver may have been a little close to the truck in front is the problem that the car driver must assess on his/her approach to joining the motorway, the truck driver cannot be blamed for the accident due to the gap between him and the truck in front. Whether the car driver had just recently passed his/her test is no excuse!
Snudger:
I’ve been in the same position as the car driver (trying to change lanes on the motorway due to cones closing off my lane and not being let in) and had to come to a stop which is not pleasant on a moving motorway).
Not to mention downright dangerous.
Sounds like poor awareness to me. You would have been notified at least 800 yards prior to your lane being closed.
That could and should have been avoided, just needed a bit of common sense, instead of I
m gonna teach this idiot a lesson` yes we all feel like it at times, i even said that the day i was retiring, i was gonna take a few cars out myself, but we never do. On approaching any slip road, i am on the mirrors, off side ( in case i have to pull out ) nearside, in case of the idiots ( we expect them to pull out anyway ) and ready to brake or ease off. It only take a few seconds, and i would rather that, than be bothered with paperwork, waiting for the police, statements , etc, not forgetting that horrible smell ( work out yourself which one )

Yes, and I didn’t cause an accident though it felt quite unpleasant (I don’t like stopping on the motorway!), but here are the full facts. Though this was a few years ago (road works at Reading) I remember it well. I had been indicating for many many seconds with plenty of road ahead; I had plenty of time to manoeuvre, first trying to speed up to create a gap so I could move over, then slowing down to let them past, simply trying to get over (I started trying to get over a long time before the cones) only for the car behind to exactly match my speed for some reason. Can you imagine how frustrating that was? Very annoying to me anyway. There was no need for it IMO. I do wonder if they were after some insurance claim, which didn’t result, but it seemed to me that they were determined to keep me in the inside lane. All I can say is that I’m pretty sure he didn’t realise that a lane was closed ahead. Anyway I didn’t barge in cos that would have been dangerous. Eventually, with this person right at my rear right the whole time, I had to come to a halt and he went by. Someone, perhaps a bit more considerate or aware, then flashed me out. Absolutely nothing resulted from this, apart from some unnecessary stress to myself. The point is that you can’t force your way in when someone else has priority. Is this situation (with the car in the video) not the same as going straight through a give way sign whilst expecting others to give way?
As for you albion. Yes I’ve seen it and hope I am not biased: as stated above, I have, as we all have, been in the same place as the car. As I said, the trucker was not found guilty of anything. If something worse had happened then his own photographic evidence would have been available and the courts would surely have decided that he was hardly driving recklessly. Of course you shouldn’t be a bully, especially on the road; he wasn’t. He was only maintaining progress. I agree he was closer than I would like if anything happened but if anything, that lack of space should have discouraged anything from entering the lane he was in, it could be argued. (I am trying to create a good impression for the trucker there I must admit). At least he handled the resulting situation well and I absolutely agree you should try to allow for others’ mistakes. As I have stated before, you shouldn’t get closer to a truck than you have to (this applies to e.g. cyclists sidling up your side in London in particular).

Thanks for your reply but we will have to agree to disagree. You say you are trying to create a good impression for the trucker!
I would love to do that as well but this guy was being a complete moron as quite a few other have agreed.
Yes he was maintaining progress and quite within his rights but if he had been a professional that incident would never have happened.
He did not handle anything well.It could have all gone wrong at any point but luckily it did not.

I work on this theory…If there are a large number of vehicles joining the motorway then I will either ease off the gas a little or if there are too many joining I will pull over into lane 2, if there is just the odd vehicle joining I will stay put in lane 1, after all I do have priority!
That’s how I roll too, at the end of the day it’s night
Do we know if any other Evidence was submitted NO
Would there have been other CCTV footage covering the area POSSIBLY
Do we know ALL the facts , NO
Maybe if this image was seen by a few of our chimp friends they may have a slightly different attitude to dive bombing ect
Think everyones attitude to dive bombing is the same, we all hate it and would prefer it not to happen.
Whats surprising is the few that take umbridge at the mere suggestion that theres a duty or perhaps even a responsibility for a professional driver to help other road users out, regardless of who should give way.
Lorry driver didnt ease off at all, didn
t brake, even when the car was getting pushed along the road he seemed to continue with his "Ill teach you to do that " way. He knew ■■■■ well the car was there, if he didn
t why not?
There`s something of a correlation between a moron and the dash mounted, or in the case of cyclists, head mounted camera user. By that I mean any Youtube clip will show a holier than thou attitude of vid-cam users…
Please remember not all cars are out to cut you up. Nice people make errors of judgement, nice people with children in the back, they make mistakes or maybe are just uneasy about driving on motorways and joining one in busy traffic can be quite daunting to some. We must, in our position, rise above this self righteous attitude where a mistake by someone can be somehow punished because we have a “big lorry”.
Well said cheeky monkey.Spoken like a true professional.Just a pity there are a few on here that have exactly the opposite attitude.
Maybe there should be a separate forum for unprofessional selfish morons?
