Doesn’t absolve the driver though, or the operator from the consequences of what the TC will do. This is just one of their “Five a Day” (bridge strikes that is)

It’s worth him claiming that as mitigation, but I’m not sure it’ll do him very much good, TCs aren’t big on accepting excuses.
