Fireworks organiser charged with manslaughter

admittedly their procedures are a bit nuts at times. a van took the side repeater off my unit a few months ago while i was assisting an engineer to repair my tail lift. he admitted liability and the shop manager contacted the relevant people to sort it out (iceland van driver, iceland truck) and i got a drugs and alcohol test 2 days later :unamused:

Sounds like you work at my place of work! (same companies). I know a bloke who slipped on some ice in the freezer and banged his elbow. He had to have an drugs ad alcohol test and an investigation meeting.

Another time a lad slipped on some spilt frozen rice. He actually got a formal warning as they classed it as an avoidable accident (he should of spotted the rice). They don’t think about the consequences of breathing down your neck pushing you to achieve targets and go above and beyond. Another reason to the long list of why I want out.

Am I the only one who thinks it was a bit silly doing something that was obviously going to produce smoke, so close to a motorway? Are those who spectated to be charged for aiding and abetting (should be, what a waste of money, fireworks)
Farmers are terrible for burning stuff near the road so hopefully this case’ll make them think twice.

The fireworks were being let off very close to the motorway.

All sorts of potential problems, including spent rockets etc falling on vehicles.

In my own mind I imagine this was more likely caused by Ivy and Jack driving up the M5 and said ooh look at those fireworks, as Ivy slowed down, the following car was also looking at them and braked sharp, then the TNT driver on cruise control jumped on his brakes when he saw two cars almost stopped in front of him.

The weather forecast said there was patchy fog yet no-one is in court for that.

The rugby club lies between two small rivers both of which give rise to patchy fog and mist.

Estobex historical weather reports say that it was foggy at the time of the incident on that day.

he got a warning for slipping on spilled rice? what about the person who spilled the rice and didnt clean it up? or was that the same person?

the river tone is the bottom one and the taunton and bridgwater canal is the top one ! i live over to the right of the map you had up next to the canel i drove home that night from the boys footy and it was the thickest fog i ve seen for a good few years down here , put it like this we could hear the sirens but couldnt see the fire until we woke up next morning looked out of bedroom window and could see a premium facing straight towards us !!!

Which is why he’s lucky that a criminal conviction needs to be proved beyond reasonable doubt not on the balance of probablities. :bulb:

If it was just the latter it would be a different story if I was on the jury.But hopefully the idea of prosecuting him with multiple counts of manslaughter will deter any other idiot in future who decides to add the hazard of a load of smoke from fireworks to a load of fog all done close to a motorway.Or for that matter a load of smoke just on it’s own close to a motorway for whatever reason unless it’s caused by an accident not by design. :imp: :unamused:

Whilst I feel desperately sorry for the families of the people who lost their lives in what must have been a horrendous accident, I really can’t see the point in charging the organiser of the fireworks.

Leaving aside the question of why there was a fireworks display being held on a night when there were serious visibility issues, perhaps he DID a full risk assessment but the wind direction changed.

Who knows what the situation was like during the planning stages and even up to the time the display was planned.

Perhaps the organiser said to the rugby club, “Makes no sense to have the display with so much fog,…” and the club officials said, “No, you go ahead, we’ve told everyone there will be a fireworks display… and they’ve paid for it…”

I simply can’t see how they can convict this poor sod of manslaughter on the basis of what little information I/we’ve all been party to.

It does seem to me to be an extension of the culture that says, someone must be to blame whatever the circumstances… and why drivers are regularly arrested after a traffic fatality, with no substantial evidence whatsoever.

Unfortunately, our country seems to have been taken over by the occupants of the asylum… and soon we won’t be able to sneeze without being sued for giving someone else a cold! And especially if we haven’t done a risk assessment before we actually sneezed!)

My sincere and heartfelt condolences to those that lost loved ones that night. It was an accident and I’m sorry it happened.

this is they way things have become, no common sense.
look at italy. they’ve sentenced some scientists to 6 years for failing to predict an earthquake.
where will this blame culture be in 10 years?
you’ll go to the toilet in the services, only to be arrested for assault on someones sinuses.
i’d get 25 years if this mornings droppings were anything to go by.

Does an event such as a firework display have to be approved by the council■■? Now, if the police or who ever are convinced this was the cause of the accident why do we think the finger is not being pointed at the council, who would have taken into account all the risks such as smoke, fireworks going astray and all right next to a motorway and then giving it approval ?
Seems a bit too sust to me and the poor organiser of the event is being made a scapegoat ?
