I am a self employed freelance driver,
Do I need to download my card if so how do I do this
Do I need to buy a reader or do I get my client to do it for me
If I get one of my clients to do it does it show information recorded on another clients vehicle if so does this infringe the data protection act?

I’m in the same situation. To answer your questions:

  1. It’s the operator who has to download it, not you.
  2. No need to buy one yourself, the vehicle operator should do it.
  3. Yes, it’ll show everything on the card. No idea about the DPA part though.

Although I would add that the Operator, actually called a Transport Undertaking in this legislation would be required to download a driver card ‘immediately upon a driver ending employment with the Undertaking.’ If you only work for a TU on an ad hoc basis, then they would best be advised to download your card at the end of each shift.

Data Protection Act doesn’t apply to the downloading of you activities for other Undertakings, although the Undertaking has to process and store data in accordance with the Act. However, the EU drivers hours rules require Undertaking to ensure drivers they employ obey those rules, how could an Undertaking check compliance if they didn’t download the card? Driver activity is stored in one file on the card, it is impossible to download only part of it.

Most of the places I go on agency do this for that very reason. It’s a bit of a faff but I suppose there’s no guarantee I’ll be back at a later date so it make sense.
