Could it be that Tosco, DHL etc. have far more power & influence than a bunch of agency workers■■?
+1
Way I see it, either ■■■■ it up and get on as you were, or look for another job. If the industry has found legal ways around the wtd, you were hardly likely to come out of this on top
Speaking to the main Unite Union shop steward@ Tesco NI last night,
he says there is a big court case down for Sept going ahead by the TUC about the AWR.
They are challenging the “Swedish derogation” Art10 clause as they say it was inserted in the AWR for use by Sweden ONLY due to their social/family working laws and never was it agreed that “all and sundry” could adopt it, otherwise the whole AWR process is a TOTAL waste.
They are also challenging the fact that the majority of agency workers who come under AWR have been illegally “press-ganged” into signing the Art10 opt out clause by the agencies.
Also received three seperate txt’s last night direct from Unite Union about “if I’m a agency worker?”/“if I’m worse off compared to full time workers?” and “if they could contact me for more info?” etc.
Something must be stirring
About time they did something,i was asked to sign 6 months ago but took legal advice first and was told not to sign and if given no work after sue for unfair dismissal after telling agency i got the money and it never came up again.Think im the only driver though.
If you have signed the AWR “Art10 Derogation equal pay opt out clause” or “pay between assignments model” you have ONLY signed away your equal pay rights you have NOT signed away any other rights ESPECIALLY the RIGHT to EQUAL working hours compared to the full time workers
You have after the 12wk period the legal right to be treated EXACTLY like you were taken on DIRECTLY by the “hirer”, the only equality thing your not entitled to is the equal wages.
due to my above post I recently put in a grievance request to Grafton about equal working hours@ Tesco NI compared to the Reg Tesco drivers.
Outcome is Tesco NI have now agreed due to the AWR to have all agency drivers on minimum 9hour shifts(paid for 8hours, same as the last recruited full time Tesco drivers some EIGHT years ago!! ) after the 12wk AWR qualifing period.
If they run out of loads before your 9hours is up your asked if you want to sign off or go sit in the canteen drinking free coffee til you clock up your 9th hour.
This now means no more short “the loads are all covered” 6/7 hour shifts and shift cancellations seems to be binned too.
