I work for an agency but only at one firm,last worked Dec21st been told no work now after 6 weeks off they text me saying im needed rest off week,just in time that they don’t have to pay me more under new laws.
Wonder if i will get 12 weeks work then another 6 weeks off.

The clock doesn,t reset after a break of a few weeks
Once you,ve done 12 weeks…thats yer 12 weeks!
Even if its spread over a year!

Thought if you had 6 straight weeks of your 12 started again,my 1st 12 weeks would of been up christmas eve so never did 12.
The rules say:
Reasons for the qualifying clock to reset to zero;
- If there is a break between assignments with the same hirer of more
than 6 weeks (which is not one which ‘pauses’ the clock or during which
it continues to ‘tick’)
so it is another possible getout & it’s what my agency is proposing to do - either rotate drivers between assignments, giving the 6-week break before going back, or just laying drivers off for 6 weeks as the OP’s agency appears to be doing.

Don’t worry about the AWR. All you need to know is if you work this week, you should get paid next week. There’s too many agency workers thinking they’ve suddenly become full time employees after being at the same site for a week or two
Been checking on Tallyman’s link,because i finnished midweek that week counts for my 12, christmas week the firm shut down so that week is not in the 6 weeks then im back in this week so that wont count so even though i have had 6 weeks of only 4 count for AWR.Now how do i tell agency im due £4 an hour more without get another 6 weeks at home.
Pay it back and go the Easter Week on Holiday

And there lies the nub of the whole AWR!!! You tell them that and you’ll have more than 6 weeks of no work. Take it to a tribunal and you may win, but will have blackened your name with every agency in the country.
I’ve asked this question of my agency, regarding where I stand, at 3 of the 4 firms I go to we’re on more money than their drivers so no problem, at the other one there is no base line comparison, as they only use agency drivers at that site, so no problem either. The only contract they have that their is a problem is one in Barnsley, but they are going down the contract route to sort that one out.
My question is, were you happy with the wage before the AWR came in? Because the way I see it, it will cost you money in the long run through these lay off weeks, before you would have been working.
I’m not saying whats happening is right, just what will happen. Its alright for people to devise these scheme’s, but its what happens on the ground that matters at the end of the day
