Agency Worker Regulations 2011

Since these regs came out, I have worked for the same company apart for around 4 weeks, where supposed to be no work, apart from a self transfer from Peterborough to Sherburn, I have worked at the same company and same agency

Nothing has been said to me regards to anything at all, basically since the regs came in, i have had probably on average 3 days work per week

Does anyone know where I stand with both the agency and company? what rights am I supposed to have (if any)

I did sign on with one agency last week, and told they can only employ me for 12 weeks only unless I go LTD or umbrella, which to me is a mockery of what the AWR is all about. loads of work came thru thou (not - none at all)

I like many agency workers, only want a full time position not all the mess about with agency muck ups

Sophie, Maybe you should contact ACAS or if you are in a union maybe them but you are at risk of putting yourself on the ‘black list’ and ending up with no work at all, sticking your head above the rest will only result in one thing. Troublemaker!!

3 shifts a week is about all you can hope for in January, well it is up here, so sit tight, use your savings for a while, the sun will shine again I quite believe that. That’s what i’m hoping for anyway.

That new agency you signed for is breaking the employment law and as there are very little full time jobs available you are forced to shut up and keep it shut, take your money (what little they give you ) and enjoy your family.

Google AWR and have a good laugh at what you’re rights are (NOT)!!

Yeh, I’ve had that before. 22 years experience. Clean license. insists on £10 an hour for nights. = TROUBLEMAKER :imp: :imp: :imp:
…Then there’s… ‘6 points on license, can’t speak English to O level standard, let alone write it, dropped a trailer on its nose last week, delivered a load to wrong address last month, didn’t have a work permit this time last year. Prepared to work for £6.50 per hour.’

I know what you mean Winseer, Im only 4 yrs behind you there, 18yrs exp, and wont work for Min wage, They either pay nuts and get monkeys or pay a decent living wage and get experience, I.e someone who don’t reply on Stupid sat navs for getting the delivery done.

I heard from the trainer where I am currently at, that they are going to spend £3 mill on transport and also will be hiring drivers between April and September, maybe if I continue to be flexible then I may get a position, I do like the job, just wish to know where I stand

To be honest, I don’t know at all.

The agency is the only main agency the company uses, it gets driving staff for their depots in all the company locations on this contract

Might be 'pathetic, but it’s a job. I was earning more than this (£8.50 & £12.75 after 40 hours) 12 years ago, but the economy has changed so given the choice of earning £8/hour or earning nothing, personally I would be happy on £8/hour.

I know for a fact that the agency I use will send in EU nationals if they can because (1) they will always maximise hours for themselves & the agency & (2) they are happy to sign any contract that is put in front of them. A TM that I know is tearing his hair out because of this - he’s even asked for me by name and the agency has lied, saying I’m not available. Needless to say I’m not doing agency work at the moment, no great loss for me, but infuriating all the same.

My son’s agency has a verbal agreement with a core of drivers to rotate them between contracts to get around the AWR. The agency don’t want to go down the Swedish route, the employers are happy to get decent drivers, (they have actually upped the rates marginally to try & keep things sweet) and the drivers get to keep the flexibility. Essentially they are just ignoring the AWR but as long as everyone’s happy then all’s well & good. It’s a pity it has to work like this, I’m all but-retired from it thank goodness but my lad really wants to carry on being an LGV driver and even he is now starting to look outside the industry.

I had such one the Agency phoned me telling no Work and 30 min later phoned TM telling me 20.00 as usual.
No i said,Agency put me off list.Ignore that the TM said.
So the Agency cancelled my Contract to them.

A lot of agencies are going to go under at the end of March I reckon. They’ve cheesed off so many people who’ve since moved to other firms that when the work picks up large, they’ll not have any staff to tender out! Client then goes to the agency that’s picked all the staff off over the lean weeks we’re in at present…

If 100 agencies have 100 staff each on their books - there are NOT 10,000 LGV drivers to place into the 2500 vacancies that might exist on a typical march week… There might be 2000 “mobile workers” and another 1000 ltd company/self employed types. 2500 therefore get jobs, only 500 get left high and dry. Now fast forward to Easter, and another 1000 jobs (albeit “temp”) have been added. Which firms are going to find out they can’t get a driver at any price, 'cos the entire agency bookload has been tendered out already?! :question:

Opening an agency these days must be like opening the 97th fish and chip shop in your local seaside town! :stuck_out_tongue:

I was talking a Week ago with one from Rumania who works for the Main-Agency here.
They get recruited in Rumania for £7.50 the Hour as that Agency has a Office there.
You cant win. I understand that some (most) complain about the Immigrants,but you need to hang the Agency who imports them and not the Driver.
Sadly,the Agency is English :wink:

INSURANCE - UP
GROCERIES - UP WAGES - DOWN
COUNCIL TAX - UP
GAS/LECKY - UP

THe fact that the bills are up and Agency wages are down is my point. FFS I could name a few companies who pay there drivers over £30k, yet agencies are screwing the drivers down to £20k. I know for a FACT that there isn’t an agency out there that in the last few years, when things have got tougher have paid there employees LESS money.

Drivers who are oh so willing to say, ‘‘AH but it’s work’’ is one of the reasons why we’re in this mess in the first place but, I do know you will never get drivers to stick together so they opt for less money to take home cause it dosn’t really matter that much cause my wife’s just had a pay rise. :imp: :imp: :imp: :imp: :imp:
