If as you said he would have been driven back,remember he couldnt drive the Company van back,it would just have been a minor Issue with a Warning or small Fine.
It would still be exactly the same issue regardless of being driven back or driving back, insufficient daily rest.

If you are going to bend the rules just record it, the punishment is always far less then for getting caught trying to hide it.

As I said before, depending on the circumstances, I MAY have done the same as the OP, but, the office would’ve had me on the phone a good few times, and I’d drop lines like, “once my 15’s up, I’ll be asleep on the bunk” etc, and they’ll usually get someone out to you BEFORE your 15’s up.

It happens. Having set a precedence with the Skills Coaches case it’s an easy conviction for VOSA and remember they don’t just look at tachos when they do a check so it can come to light.

Thing everyone needs to remember if it’s a one off and you work for a green light company then in the first instance you are exceptionally unlikely to be stopped for a roadside check by VOSA and secondly if they do then they’ll probably just make you aware of it and not to make a habit of it.

Got stoped by vosa a few weeks back and had a couple of 2-3 minuites over over a period of months and the guy was ok.

Being on boxes I’m a little lax with my times and run on break. Never been a problem, but I do write on the back if I notice the odd 1/2 hour.

Luke has it about right in this case, calm down and stop listening to the horror stories, they are made up in an RDC most of the time, the horror stories you read in the transport media are systematic abuse of the regs
I stuck last Winter in london when they run out of Gritting and came back with 17 hour.Just 5 hour driving.
phoned them when i noticed that i can’t do it with 15 Hour and got said “Carry on”
Just as they dont pay over 15 Hour i got the 2 Hour cancelled i was waiting for a key at beginning of my shift.
Dont worry.Gave them a hard Year for not paying me the 2 hour.

Hiya…best thing is to tell no one… not any body… no f…er…keep stum and you may get away with it.
many drivers have done half as much again in a day but told no one untill many years later.
now if you want every one to know about the deed print it on TN or the daily star then you
may get caught /fined and may also loose your job. get the idea.

And we are going over to one of them electronic palm reader things now, so you cant fiddle it.
What’s it to do with vosa what time you clock on and off ? I clock on between 10 - 15 mins before my official start time to have a coffee because I don’t have one before I leave home. It’s your official start time they’re worried about .
Had VOSA round at my works to do a check when we where changing over to unrestricted O licence, he noticed the clock in machine and asked if I was paid via the times I clocked in and out. Because I am then from when I clock in until I clock out is classed as duty time regardless of when I put the tacho in and If I put the tacho in after 15 mins from clocking in then I must do a manual entry to account from clocking in time. Same rule applies if you use a time sheet to show your work record. Time sheets and clock in cards can be used as evidence in court if VOSA suspect tacho fiddling.

This is what I got sacked from Maritime for, my tacho and timesheets didn’t tally exactly. I always thought you were aloud 15 mins either side to sort paperwork etc, but even that has to be recorded.
But, rather than training, explaining the mistake etc, they just hand you your p45

Nowhere hear enough information to assume that. It doesn’t say when he was told to write on the back of the printout. If he didn’t alert traffic to his situation and only told them what had happened on his return then they simply could be advising him to write some sort of explanation in the hope it will help if he gets stopped.
