Just a quick question. One of the day drivers today has had a 16 hour day today. 5am till 9pm. Now he is new so when i asked him about it he said traffic told him to right on back of print out. He went over on time getting loaded. Then did a half hour drive back to yard. Now what sort of consequences is he gonna get if any?
How much driving time did he do??

And it will be on his card for months if he used one.
Did less than 9 hour driving. And was on a digi card
If it is not found in the next 6 months he’ll be okay, otherwise it will be a fine.

if you hit clock card at our place, you better make sure you hit it at a maximum of 15 hours later, then he will only pay you 14, and if ministry come in and look at machine and find you over 15 on the clock, you and company are in the ■■■■■■ And we are going over to one of them electronic palm reader things now, so you cant fiddle it.

What’s it to do with vosa what time you clock on and off ? I clock on between 10 - 15 mins before my official start time to have a coffee because I don’t have one before I leave home. It’s your official start time they’re worried about .

Yeah coffee, but I think he means it’s not 16hrs, it’s still a 15hr limit, just doesn’t count as a reducer.
Clearly that isn’t the problem here though, as he’s asked the question and they’ve told him to do a print out, so no mis-interpretation, just blatent breaking of the rules.
If you’re stuck somewhere, we’ve all done that, but driving a couple of mins to find a safe ■■■■■■■■■■■■ is different to 1/2 hr to get back to base. If I was that close, I’d be tempted, but I’d expect work to send someone out to take the truck back to be honest, usually saying “fine, I’ll have a night out then” will get someone down to bring the truck (usually loaded with goods for a night trunk) back to the depot.

if he was only 30 mins from the yard if had kept them informed of delays why didnt they send someone to swap with him.

As JD and myself pointed out, if you’re that close, why didn’t they just get someone out to the OP?
Unlikely a company with that attitude is a green light company, and, if they are, they won’t stay that way for long.

Got stoped by vosa a few weeks back and had a couple of 2-3 minuites over over a period of months and the guy was ok.
I’m always dubious when someone says got nicked for been one minute over

The OP says it was a duty time issue, not driving time, so getting someone out to the driver would only have solved the problem if they had done so during the delay in loading and leaving him enough time to get back within the 15 hours. If the driver didn’t make them aware until it was too late then if he isn’t going to night out he might as well take it back himself because either way he will be over his hours.

I know what you’re saying Coffee, but I’m sure the driver kept them upto date along the way, if not, he’s a bit of a fool, but I think driving for 1/2hr once you’re over your 15hrs is asking for trouble.

Thereby turning a small offence with a possibility of a small fine into a much bigger offence with the possibility of a much larger fine or even a prison sentence.
If you are going to bend the rules just record it, the punishment is always far less then for getting caught trying to hide it.
