Instant dismissal

Your presumption is mistaken - I have had the misfortune to be out of work. Some years earlier I also had the misfortune to find myself in serious debt (my fault entirely, living beyond my means etc). It was my experience during that serious debt episode that impressed on me the need to have an emergency fund in place to cover my living expenses for 3-6 months just in case I lost my income. As a result, when a few years later I found myself out of the secure employment I had enjoyed for 25 years it didn’t cause me any significant difficulty. The mortgage, council tax, household bills, vehicle running costs etc were all comfortably covered while I found myself other work, and would have been covered for a couple more months if push came to shove.

The issue is that even where I now work there are full time drivers who would be up ■■■■ creek without a paddle if even a single monthly paycheque failed to materialise on time. Not one of them has the foggiest idea exactly where their money goes each month - apart from the biggies such as rent/mortgage/council tax, all they know is that it’s just about all gone by the time the next paycheque arrives. That should worry them.

Sadly one of the things that is seriously lacking in our education system (and I include parents in that system) is basic money management skills.

Unless you have a specific clause in your Contract of Employment, an Employer can ask you to leave the business without legally having to give you an explanation, if you have been there 2 years or less. Of course it goes without saying that they must have their reasons in case this decision is challenged legally, they just don’t have to give them at dismisall.

Regarding working the notice period, if you have been escorted from site then no right minded employer “should” ask you to work the notice period. This alone can be the first step in a Constructive dismissal case, should you so choose. That said any solicitor who specialises in employment law will tell you, that it is very difficult to prove a constructive dismissal case, when you weigh up the “Risk v Reward” factor.

From what you have written, I would be of a mind to decline working the 1 week notice period and forego the pay, assuming that fits financially with you. Sometimes it is easier to walk away and find employment elsewhere. In cases like this, you just have to overcome personal pride and walk away with your head held high.

They sound just a really bad company, I’d walk away and leave them to it myself The whole tribunal thing, forget it would be my advice. Any award would be so notional as to be irrelevant. If they are escorting you from site, then I would expect them to not want you there at all and to give you the appropriate money in lieu of notice + any outstanding holiday pay.
