A driver(s) at my yard have been getting routed over 9 hrs driving quite a lot lately and are a bit miffed!
We are not night out drivers (class 1 &2 )and isnt in our contract, we do chill/freeze deliveries and are due back to the yard that night within 15 hrs(sometimes!!!)
Management say we can drive 10 hrs-
we say yes we can- but its up to the driver if he uses the 10th hour driving to get back home in time ,(or it usually turns into a rescue and you might get picked and back to the yard within 15hrs- if your lucky!)
So should they be routing us over 9 hrs driving? we say no.
Also if a driver doesnt reach base within 15 hrs and they send someone to collect him , they try to say he is on rest on way back- again we say no- cannot dispose of his own free time and is in a company/on hire to company vehicle travelling to base, only way round it would be to give him a car and say go home- then they are on rest?
If they are routing runs of over 9 hours then it must balance out with shorter runs within the consecutive two weekly period as only 90 hours are available over any two consecutive weeks - I am right in my thinking on this
Yes, but im looking for evidence that they shouldnt route over 9hrs as we dont do overnights, they try to work us 60hrs per week if they can butusually driving hours is down as we get short and long runs,its just the 9hr routing , if i can show they shouldnt do it i can stop it!

You will not find any such evidence
The only recourse you have is that of safety - if too tired to complete such a run once started and then turning back home with a drop or two stil on board.
I doubt if you will get flak for a safety issue and if you did then say that you will not accept what they are saying unless it is in writing - they will not put it in writing as they will be shooting themselves in the foot.
But all this is silly - why not just simply get a few like minded drivers together and have a meeting with the bosses - get someone to take the minutes of such a meeting.
If in a Union - even better - they will approach bosses for you.
There is nothing right or wrong with an employer scheduling a ten hour driving day, although good employers will build in a realistic ‘margin’ to allow for problems occurring during the shift.
As far as the EU Regulation is concerned, if you run out of driving time then you may be ‘rescued’ and taken wherever you want, provided you have duty time available for the journey. If you run out of duty time then you take the daily (or weekly) rest period at the place where you run out of time. Travelling in a moving vehicle is NOT rest unless it is on a ferry or train and you have access to a bunk or couchette.

so if you get to 15 hrs, they cant send a car out with 2 drivers in, 1 to drive the truck back and 1 to drive you home in the car, you have to have a daily[ weekly] rest , what happens if they want the truck and trailer, or just the trailer, it may be full of dated food.

I used to have a picker outer but never knew what to call it
Oh I forgot myself, remember 9 hours and 2 minutes counts as an extension to your hours so as you may be hung like a horse, you may as well carry on driving till you almost reach 10 hours.

but thats what im saying, they send out 2 drivers to collect you, 1 to drive your truck back, and 1 to drive you back in the car theyve come in, surely as your not driving the car your on rest , this is how weve always done it

If your maximum work hours for that day are up and you sit in that car as a passenger then you are illegal as it is OTHER WORK - the regs are quite clear on this.

Travelling time
Where a vehicle coming within the scope of the EU rules is neither at the driver’s home nor at the employer’s operational centre where the driver is normally based but is at a separate location, time spent travelling to or from that location to take charge of the vehicle may not be counted as a rest or break, unless the driver is in a ferry or train and has access to a bunk or couchette.

simple - print off the regulation - enlarge it - do a few copies and present one to him - then if he wants you to do other, tell him that you want that in writing.
