Daily rest, weekly rest, compansation, confused!

Ted I must have been using my drivers hourgaurd for too long because my head hurts. :blush:

What timer do you use? Maybe, if your illustrated work patterns are normal you would benefit from using said timer.

My head is also hurting but having read through it several times I have arrived at the following.

By the end of week two you have to compensate for the reduced rests you took in week one and this amounts to 2 hours 50 minutes, 2 hours on the Tuesday and 50 minutes on Wednesday and this is taken care of on the Wednesday of week 2 when it looks like you did a split rest, 4 + 11:25, so the 3 hours 25 minutes attached to the 8 hours can be used for compensation.

You only had a 39 hour 15 minute weekend break at the end of week one leaving 5 hours 45 minutes to be compensated for by the end of week 4, the end of the third week following the reduction.

In week 2 you have reductions to compensate for totalling 4 hours 25 minutes, 2 Tuesday, 40 minutes Thursday and 1 hour 45 minutes Friday, which has to be paid back by the end of next week and you had a reduced weekend break of 38 and a half hours leaving 6 and a half hours to be paid back by the end of week 5.

Week 3 you had reductions totalling 4 hours but the good news is you had a longer weekend break. You say you will be starting at 04:00 on Monday of week 4 so that makes a weekend break of 63 hours and 15 minutes. This means a full break of 45 hours plus you can pay back the weekly rest reductions owing, 5 hours 45 minutes from week 1 and 6 hours 30 minutes from week 2. The 4 hours 25 minutes owed from last weeks daily reductions must also be paid back here. 45:00 + 5:45 + 6:30 + 4:25 = 61:40. This means that you can also pay back 1 hour 35 minutes of the 4 hours reductions you had in your daily rest periods in week 3.

As far as I can see you ran legally and can start at 04:00 on the Monday of week 4 but you must pay back the remaining 2 hours 25 minutes owed from week 3 reductions by the end of week 4. Remember these periods must be of not less than 1 hour and must be attached to a break of at least 8 hours.

thanx 4 all ur inputs. I do actually have a driverguard timer but arent able to use the compensation side of it, i find it totally confusing. I think its brill wrt daily duty and drivers hrs but thats all i tend to use it for.Maybe i need some training or need to read the info that came with itā€¦

Ted, Im in the same boat mate, Im flummoxed by the rules, but I believe that the best way is get to grips with the hourgaurd. Im having a look at the detailed instructions for the gaurd, and if a thicko like me can crack it eventually, anywone will. If I work it out, Iā€™ll post!

:smiley: I gave up on my hour guard shortly after trying to use it. Iā€™ve tried to figure it out since but even the dummyā€™s rules as found on this site are hard work.

If anyone wants it, they can have it, coz itā€™s just sitting here doing zip.

I use a ā€œBIG KITCHEN TIMERā€ which I think I found in Asda :confused: They do them in all truckstops for a few quid. Loads of drivers have got them. I use a filofax to record how many hours work Iā€™ve done and such. Never had any problem with this method and never had any tachos come back with descrepancies other than the odd one on a Friday night going over time by 15 mins-ish to get back home :blush: They (Dft) seem to leave you a bit of slack for that if youā€™re spotless the rest of the week. Canā€™t say fairer than that.

On a Friday, or your last duty day of the week, the Daily rest rule applies until 24Hrs following duty start. However at duty end the weekly rest starts.

If the duty period is less then 13hrs, can the extra daily rest be used as compensation? however this rest is actually part of your weekly rest. And what happens when this weekly rest is shorter than 45hrs.

If i put down my duty and rest periods for the last three weeks can you please tell me if I ran illegally or not?And am I ok to start tomorrow at 0400?

this was a 29hour and 40 minute day - shouldnā€™t your 8 hour period of rest finished by 4.00 Wed ?

Sorry Dennis, something else I get confused about, when I do a split break I forget to minus the split hours from the dutyā€¦
