I got an infringement for this working week- Why?

As the post says - I got an infringement for this working week but can somone tell me why and how to aviod in future as I am an agency driver I am left to work these things out myself :–))

Sat - 07:30 - 22:15 ( 14:75 )
Sun - 08:00 - 23:00 ( 15:00 )
Mon - 20:30 - 11:30 (15:00 )
Tues - 22:45 - 10:45 ( 12:00 )
Weds - 21:30 10:15 ( 12:75 )

Weds - 21:30 10:15 ( 12:75 )

4 REDUCED RESTS - ONLY 3 ALLOWED

NEEDED TO START AT 21.45 ON WEDS

69.5 hrs worked,even with a break taken off that for each day will
still put you on 64.5hrs for the week…Max is 60hrs unless you start using POA

As said you’ve had 4 reduced daily rest periods between weekly rest periods.

If you’ve had an infringement notice it should tell you what the infringement is for, that’s the whole purpose of them.

You don’t have to use POA to keep the working time down, break will keep your working time down without wrongly resetting the driving time shown on the tachograph display.

Yesss thank you guys for you quick responses but it was due to 4 reduced rests instead of the 3. So by 15minutes earlier rather than later has cost me a sodding infringement. Pffff

If I would have started on Tuesday at 22:15 instead of 22:45 I am guessing that would also be a reduced ?

Tuesday was a reduced daily rest period because you never had 11 hours rest between Tuesdays and Wednesdays shifts.

You finished on Wednesday morning at 10:45 and started work again at 21:30, that’s 10 hours 45 minutes rest between shifts.

If you started at 22.15 on tuesday then it would change nothing because you still only have 9 hours of rest from ending monday because monday you did a 15 shift so 15+9=24

Forgive me if I’m wrong but I’m guessing that you’re making the mistake of thinking that a reduced daily rest period is when you work more than 13 hours and if you have less than 11 hours rest it’s another reduced daily rest period.

  • A regular daily rest period of 11 hours must be completed within the period of 24 hours from the start of the shift.
  • A rest period of less than 11 hours but not less than 9 hours (in the period of 24 hours from the start of the shift) is a reduced daily rest period.
  • You can have 3 reduced daily rest periods between weekly rest periods

Those are the only criteria for a regular or a reduced daily rest period.

Even a rest period of more than 11 hours will result in a reduced daily rest period if less than 11 hours of the rest fits into the period of 24 hours from the start of the shift.

It’s all about how much rest you can fit into the period of 24 hours, the only reason some people refer to 13 or 15 hour shift being regular or reduced daily rest periods is because a shift of over 13 hours means you cannot fit an 11 hour rest period into the period of 24 hours from the start of the shift.
A shift of 13 hours and 1 minute means you can only fit a rest period of 10 hours 59 minutes into the 24 hour period.

The shift that started at 22:30 Monday and finished at 11:30 Tuesday was a reduced daily rest period only because you couldn’t fit an 11 hour rest period into the period of 24 hours, therefore you could have had a 9 hour rest period after 11:30 Tuesday and it wouldn’t make any difference.

Yes I was looking at doing over 13hrs being a reduced and under 11 being another reduced but what I can see is it being in the 24hr clock rather than a rolling clock so to speak.

12:30 to 21:30 is 9 hours so that’s the time you can start work.

You cannot do more than a 13 hour shift tonight though.
