Never had card downloaded

Somebody I know got let go from their first driving job of 6 months because they never had their card downloaded, he said he was never asked for it to be downloaded. I thought it wasn’t the drivers responsibility to have it downloaded

Driver responsibilities:

Using a digital driver card to record all work and driving
Making sure the card and tachograph is working correctly
Only holding one card (unless within one month of expiry, when two cards can be held)
Allowing employers to download driver data from card
Applying for a replacement card if lost, stolen, damaged or malfunctioning within 7 days.
Whilst waiting for the new card to arrive, taking print-outs at the start and end of each working day
Not using anyone else’s card or be in possession of forged or altered card
Not recording false data or destroying any data on the card
Carrying the card at all times when working
Producing the card for DVSA officers or the police when requested

Transport Operator responsibilities:

Making sure all drivers do all of the above
Having a company card to download the recorded tachograph data
Downloading driver data at least every 28 days
Downloading vehicle data from the tachograph at least every 56 days
Analysing the tachograph data to ensure rules have not been broken or breached
Making sure the tachograph is equipment is working correctly
Making sure the tachograph is calibrated every 2 years
Making sure any defective tachograph is repaired without delay

How did they go so long without it twigging? I found out after my first week. I know they don’t teach you any of this with DCPC but there are certain clues and hints you’d pick up fairly quickly.

I don’t know tbh, I don’t know how the company went so long without saying anything either

I read this, I don’t have any issues myself but it’s a tad confusing

Most companies tell you to download daily. Last place was once a month but they where cowboys.

I down load mine weekly or it messes my pay up

If the driver presents the card to the employer for downloading and the employer does not do it then the driver needs to make a note of that date because the driver has done their job but the employer has not done theirs

Sounds stupid that it went 6 months…

The driver has to allow it to be downloaded if asked, he’s done nothing wrong if it’s not been downloaded and he’s never been asked.

The only rule I cared about when I read them was making your card available to be downloaded, as that was all that mattered. Bollox am I ever returning to a place just to get my card done, so unless you know in concrete you’re going to be there tomorrow, download it!
If their machine is playing up (as they do) do as ROG says, as then they can pay me if they want it done later in my own time…

Mine gets done weekly, as with blue estate it’ll mess with our pay if it’s done any more. “Apparently”
