The profit is in the Sub-Contacting of loads …and Sub-contractors who pull for you…but they are rapidly becoming a dying breed and with things as they are its not hard to see why.

I haven’t set foot in a truck for 4 years now, and I don’t miss it one little bit. I sometimes get a romantic notion of running a truck or two again, but quickly get someone to give me a good swift smack in the face when my mind runs off in that direction. To be honest, working as an employed driver isn’t a safe bet anymore either.
Wouldn’t mind a one off trip down to Italy or something for prosperity’s sake but certainly wouldn’t want to rely on it to pay the bills!

You cannot run with those type of costs coming out of the bank,can you be prosecuted for the same offence, even in Spain?
No. once you have been done by any enforcement authority in any member state they should issue you with some kind of paperwork which shows you have been punished. You then produce this at any subsequent stops in the same or a different country to avoid being done again.

proceedings until such time as the same infringement of this

It could also mean the driver didn’t abide by the ruling of the first stop IE: park up for the rest of the week until your hours are back on track so got fined for that rather than for originally exceeding 90 hours?

Also for a Master Bs’er a tale of getting done for different offences rather than twice for the same offence doesn’t have the same jaw dropping level of incredulity for his star struck audience.

Couple of points strike me…
Perhaps they got too big in two short a time neglecting their core business efiiciency.
There are numerous advantages of leasing over buying (it’s sounds as though this was the case with Mortimer’s).

There are numerous advantages of leasing over buying (it’s sounds as though this was the case with Mortimer’s).
Leasing is certainly the way to go… especially if the lease is all in …better than HP… and certainly better than buying
I don’t undertand why anybody would buy these days… trucks depreciate at a unbelievable rate… ye pay interest on the deal… and then the emissions change rendering you investment only fit for export…not to mention the cost of repairs…andf then when you have finished paying for it… you think … ah getting old now… need a new one… and you do the whole thing again

My firm buys all it’s own trucks, cars forklifts etc etc, when you hit hard times you have cash ■■■■■■■ in several assets which you can liquidate and pay off your drivers and creditors or improve your cash flow and ride out the storm until things improve.
You only after look at some of the high profile casualties recently who had vehicles on finance and no money left to pay their unsecured creditors including hard pressed subbies!

maybe Toby will come on here and try to defend my comments…normally he does especially when many were putting down his wage structure…fact is that the company have not paid their drivers since 7th october…fact is they have put nothing in writing to their drivers…fact is all drivers are still effectively employed by d mortimer and sons and are entitled to full pay each and every day up to official redundancy…fact is drivers who wait to claim what they are owed may only get the government minimum if the partnership is disolved and becomes insolvent…all creditors will be paid in full as is stated in the official creditors report…if claims are not made then the company will escape initially and the tax payer foots the bill…fact is all drivers are entitled to be treated fairly and within the law…please please please help to save and protect our industry…stand up for our rights like the french do !!! we have become a nation of just sit back and let it happen…be walked over by companies and the government alike…I INVITE TOBY OVENS TO DEFEND HIS COMPANY AND PUT THE RECORDS STRAIGHT…JUSTIFY HOW HIS COMPANY HAS TREATED THEIR DRIVERS AND THEN REGAIN THE RESPECT HE HAD IN THE INDUSTRY…IF TOBY HAD HIS OWN BUSINESS HE WOULD MAKE A GREAT BUSINESSMAN AND BOSS…SHAME HE HAS BEEN LET DOWN…

You may have well founded grievances against the family who run/ran that company.But I would suggest that you try not to aggravate the situation by posting , what their legal representatives might see as Libelous/Slanderous claims on this public forum. I am surprised that the forum moderators, who you now say have removed your posts, have not explained clearly to you, why they have done that. They may well be acting on legal advice in removing your posts.
If so, you should take that as a warning.
I am making this suggestion to you, not as in any way as a supporter of the Ovens family, I have never had any dealings with them. But as a former Trade Union representative, (not in this industry), who is aware of the dangers in publishing comments about a company, which they could claim to be causing damage to their reputations. Both business and Personal… You could be doing your own case more damage than you realize, by publishing your claims on this site. I suggest that you pack in posting your claims on this site. That you contact your nearest Citizens Advice Bureau, and explain your problems to them.
I hope you see these as being friendly words of advice.
