Big thankyou to night drivers in harlow

Last night i was in harlow for 13 hours yesterday inc 9 hours off, i ran out of hours on the bay at 21:50 and i was not tipped after 3 hours… when i told them i was not moving the truck as it will be illegal a manager told me i was and going off site onto the public highway end of story. I turned arround and all of those drivers sat there had a go at him and i thankyou for that. He did recieve a massive telling off from his manager for saying that infront of you all so i hear. So thankyou and was nice to see fellow truck drivers standing together. I recieved my free breakfast and it was a plate full. Every Little Helps :laughing: Hopefully that depo will get a grip of itself now!!

But i cannot say thankyou enough… safe trucking guys.

that manager sounds like a right plank, whats he gonna do if you didnt get back up and wanted you to move?

and what takes soo long to tip?

Moving outside off the card was also a big contributory factor to how RF Fielding lost their O licence when faffing about in Sains, T and Co.

I assume that when you got within an hour (minimum) you made them well aware of the situation?

Pleased to hear you got a result though. Aren’t you entitled to have bay either side coned off so you are not disturbed?

You also need to have words with your planner, as sending you into an RDC/supermarket co. type tip towards the end of your shift is just asking for trouble.

Personally I would follow it up with a letter to VOSA to the effect that an employee of the holder of an Operators Licence sought to ‘Procure’ an offence(s) relating to Drivers’ Hours Regs.

Conduct that can be construed in the terms of, “Aiding, abetting, counselling or procuring” (a Summary offence) is prosecutable under the Magistrates’ Courts Act.

Not that I would consider with any sense of glee that they might get required to attend before a TC and have their Licence ‘curtailed’ over such a matter. :unamused:

Only just got back on to reply… I gave them 2 1/2 hours to tip me and did warn them as soon as i arrived the clerk on the desk called me a bull [zb]and i was not impressed. They eventually got the truck off the bay and i did not move it another driver of our company pulled it off on his digi card and parked it opposite. I had no choice as they backed me in a corner and said that although i have my keys and the bay is closed it breech’s health and safety i told him that there policy was no keys no tip so there was no need for them to be on me. Good news though since wed night tip times have been improved and our drivers are reporting 1hr max against the 2 to 3 hours they have been experienceing for the past 2 months. So hopefully the depo manager got a reality check on his depo and did something about it.

When it gets to 30 mins of your time being up cant you just get your keys back and leave? Thats whats been happening at Sainsburies Stoke. No messing around, just ask for your keys and you get them there and then! Bye bye, ring for a re-book.

Protection from Harassment Act 1997
1997 CHAPTER 40
England and Wales
1 Prohibition of harassment
(1) A person must not pursue a course of conduct–
(a) which amounts to harassment of another, and
(b) which he knows or ought to know amounts to harassment of the other.

(2) For the purposes of this section, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.

(3) Subsection (1) does not apply to a course of conduct if the person who pursued it shows–
(a) that it was pursued for the purpose of preventing or detecting crime,
(b) that it was pursued under any enactment or rule of law or to comply with any condition or requirement imposed by any person under any enactment, or
(c) that in the particular circumstances the pursuit of the course of conduct was reasonable.

2 Offence of harassment
(1) A person who pursues a course of conduct in breach of section 1 is guilty of an offence.
(2) A person guilty of an offence under this section is liable on summary conviction to imprisonment for a term not exceeding six months, or a fine not exceeding level 5 on the standard scale, or both.
(3) In section 24(2) of the [1984 c. 60.] Police and Criminal Evidence Act 1984 (arrestable offences), after paragraph (m) there is inserted–

And what makes it even more interesting is that, accepting that I am about as rusty as a Lancia Delta on the subject :laughing: , the last time I looked, “Conspiracy”, as in “Conspiracy to Harass”, would be Contrary to Common Law and therefore have no defined maximum penalty.

Where you take it from here is a matter for yourself but I would be inclined to not let it rest. However, I have the luxury of being able to do that. Others may not. :wink:

How has a Tesco manager got any responsibility to VOSA? You do not need a CPC, an operators licence or even a Gillette Mach 3 to be in charge of a distribution centre.
