Only asked as followed one other day early morning and saw driver had chucked ■■■ out window as the red ambers rolled and scattered as it hit the road. No one in front. But guess any vapours would be trailing not near cab so 1000% safe, legalities a side.

I am unsure of that when checking ADR unless there is something in the CDG Road Manual that I have missed. Now I know the rules are many in ADR but wouldn’t you think it would simply say No SMOKING when carrying any product with a flashpoint <60c or something?

I see a difference with “in vehicles” and “on vehicles” Does it mean within the confines of the container, tank or gantry, or does it just mean while handling, loading unloading. Certainly smoking on a petrol tanker may not be wise, but is it illegal to drive one when it is closed. The second picture shows the ADR regulations for certain classes namely Class 1 Explosives. Class 1.4 is not included which is the lowest of the explosive class.
It is not illegal for the rep in his own BMW to throw a cigarette out as he overtakes a petrol tanker, it is not illegal to walk past a fuel station with a cigarette. I remember when many tanker drivers smoked pipes, although that seems to be a thing of the past.
you will find any petrol terminal has a ban on things like lighters/matches and carries instant dismissal. so if you "light " a ■■■ in cab where did you get that light from. any source of ignition other than starting the truck is generally banned.
also the transport companies usually state that in their rules as with mobile phones unless they are intrinsicly safe

That is true, but is that a common sense approach or is it because it is against the law?
If you drive into Lindsey Oil Refinery there are bus shelters around the site, each with an intrinsically safe glow plug fitted so the workers can have a smoke. I am not sure whether they still have them since the workplace smoking ban, but they are only covered on top and back so would be allowed normally.

I can confirm the above, i delivered some sand and gravel to a civil engineering firm last year working within the confines of the BP depot at Hedon nr Hull, after watching the safety induction video for 45 mins, the two gatemen searched the cab and confiscated my sat-nav, dash mounted cigarette lighter, torch, cab phone and was told to keep the radio turned off whilst on site, i was escorted by a van driver from said civils company to the section they were working in ( no driving about getting lost permitted in their) off loaded goods and escorted back to the main gate, where the gateman handed back the plastic bag with all my kit in it as i went under the barrier. I did notice they had bus shelters/safe quarantine areas for the smokers though tucked away in the corner.

I belive litterings is an offence, and throwing a lit ■■■ out of a car windows is a very stupid thing to do, it has been know to set fire to other vehicles once it becomes lodged somwere with an airflow past it

Littering is a separate offence and not connected to this thread, although if you ride a motorcycle you would probably agree that chucking ■■■ ends out should be a hanging offence.
Many years ago Shell-Mex driver’s were encouraged to ‘shop’ any workmates who smoked in their truck with a cash incentive, my uncle was on the office staff at the time but very few were fined.

My mates lorry caught fire a little bit when a lit ■■■ went through the grill and set the sound deadening on fire.
TDG introduced in cab cameras and sacked one driver at Thurrock for this.

Yet out of all the things likely to cause the fire, The engine/Altenator stands much higher odds than anything on that list!
